This agreement is made between Friends of Ferrum Park ("the Park") and the undersigned Vendor. Friends of Ferrum Park agrees to provide a designated space for the Ferrum Farm and Craft Market from April 17, 2026 through October 9, 2026. To participate in the Ferrum Farm and Craft Market, the Vendor must agree to the following terms regarding legal compliance and liability:
1. Compliance with Virginia State Law
The Vendor acknowledges and agrees that they are solely responsible for ensuring their products meet all applicable local, state, and federal regulations. This includes, but is not limited to:
● Virginia Cottage Food Laws (VA Code § 3.2-5130): Vendors certify that their products are properly labeled with the producer’s name, address, product ingredients, and the required disclaimers
● VDACS/VDH Regulations: Vendors selling non-exempt items (e.g., meats, acidified foods, dairy) must maintain valid permits or inspections from the Virginia Department of Agriculture and Consumer Services or the Virginia Department of Health.
2. Release of Liability and Indemnification
The Vendor understands that Ferrum Park provides space for the sale of goods but does not inspect, verify, or guarantee the safety or legality of any products sold by individual vendors.
Release of Liability The Vendor hereby releases Friends of Ferrum Park, its Board of Directors, and employees from any claims arising from product sales, foodborne illness, or consumer disputes.
Indemnification The Vendor agrees to indemnify and hold the Park harmless against all legal fees, damages, or penalties resulting from the Vendor's actions or products.
3. Operational Requirements
Setup Window: 1pm-2:30pm Fridays through October 16, 2026.
Market Hours: Fridays, 3:00 PM to 7:00 PM through October 16, 2026.
Safety: Vendors are responsible for securing their own displays and ensuring all equipment (e.g., tents) is weighted and safe for the public.
4. Vendor Certification
By signing below, I certify that I have read the above and agree with the above. I further certify that my business is in full compliance with Virginia Cottage Food Laws or other applicable health regulations, if applicable.
